1. All sales are final. No refunds or returns.

2. Crop availability is weather dependent and may change at a moment’s notice. Kackleberry Farms, LLC. will not issue refunds in the event of crop failures or shortages.

3. All ticket purchases are non-refundable and non-transferrable.  Farm hours & operating days are subject to change without notice due to weather or other reasons.  In the event of mechanical failure or inclement weather, Kackleberry Farms, LLC. may close attractions without notice.  

4. By entering Kackleberry Farms, LLC., you consent to your voice, name, and/or likeness being used, without compensation, in commercial film or photography in conjunction with Kackleberry Farms, LLC. advertising and all media whether known or hereafter devised, for eternity, and you release Kackleberry Farms, LLC., its successors, assignees & licensees from any liability whatsoever. 

5. Ticket Refund Policy: There are NO refunds. All tickets sold are non-refundable under any circumstances. Please make sure you are able to attend the event before purchasing a ticket. You may also purchase "Purchase Protection" for $3.99 per each ticket and this guarantees a full refund for each unused ticket with purchase protection.

6. Event Weather Conditions: This event will remain open in inclement weather unless otherwise posted on our Facebook or Instagram. We work hard to provide a great outdoor experience for you here on the farm, but we cannot control the weather. We are committed to providing a safe environment for our guests and staff and some attractions and activities may close for everyone's safety. 

7. Ticket Resale: Tickets purchased for this event can be freely resold or transferred. However, the original purchaser is solely responsible for ensuring the transfer of their ticket and we will not be held liable for any issues arising from the resale or transfer of a ticket.

8. Age Restrictions: This is a general event open to all age groups that follow eclipse viewing safety guidelines. However, children under the age of 13 must be accompanied by an adult at all times during the event.

9. Photography and Videotaping Consent: By attending this event, you acknowledge and consent to be photographed and videotaped. You hereby waive any rights to claims for payment or royalties in connection with any exhibition, streaming, televising, or other publication of these materials. Your consent includes, without limitation, all rights in connection with any future promotional materials about this event.

AGREEMENT AND WARNING: I understand and acknowledge that, except for limited circumstances listed below, an agritourism activity provider is not liable for any injury to or death of a participant resulting from an agritourism activity. I understand that I have accepted all risk of injury, death, property damage and other loss that may result from an agritourism activity. I understand that an agritourism activity provider is not protected from liability if the provider: (1) Performs an act in a grossly negligent manner and causes injury or damages to a participant. (2) Purposefully causes a participant's injury. (3) Acts or fails to act in a way that constitutes criminal conduct. (4) Recklessly fails to warn or guard against a dangerous condition that causes injury or damages to a participant. A dangerous condition is a condition that creates an imminent and substantial risk of injury or damages to a participant.
